DESCRIPTION:The Inns of Court Victoria is pleased to announce that it will be hosting a 2-hour in person seminar on Successful Mediations. \nA successful mediation is often the best way to save your client stress and money\, preserve court resources\, and reduce your overall workload as a lawyer.  What makes for a successful mediation?  This panel\, composed of an experienced mediator\, defense\, and plaintiffs’ counsel will discuss techniques to making the most of an opportunity to mediate a dispute\, including: selecting the appropriate mediator for the issues\, the best timing for a mediation\, content of mediation briefs\, preparing and managing the client\, understanding the opposing party and their authority to settle\, pre- and inter-mediation negotiating strategies\, modes of mediation (ex. plenary or not\, virtual\, multi-day)\, optimizing the role of the mediator\, mediation agreements and minutes of settlement\, disbursements and bills of costs\, and avoiding post-mediation loose-ends. \nPanelists: \n\nLeslie Slater (mediator) – completed degrees in English\, psychology and law at UVic before joining Carfra Lawton LLP in 1987.  Leslie worked as a partner at Carfra Lawton for 30 years\, primarily in injury and insurance disputes\, before starting Slater Mediation Services in 2016.  Leslie now devotes her practice exclusively to conducting mediations\, when she is not golfing.\nDan McDonagh (defence counsel) – completed degrees in history and law UVic and was called to the Bar in 1991. The first 10 years of Dan’s practice was primarily in criminal defence and plaintiffs’ personal injury\, and in the last 21 years he has focused on personal injury defence as a partner with Hatter\, Thompson\, Shumka & McDonagh.  Aside from his well-honed mediation skills\, Dan is known for his relentless sense of humor.\nDarren Williams (plaintiff counsel) – completed degrees in psychology and law at UVic before being called to the Bar in 2001.  Darren has focused his practice for the last 20 years on estate\, injury and maritime disputes\, primarily representing plaintiffs. DESCRIPTION:The Inns of Court Victoria is pleased to announce that it will be hosting a 2-hour in person seminar on International Law and the War in Ukraine: assessing criminal liability and legal challenges. \nDirk Ryneveld\, Q.C.\, who was the senior Prosecuting Trial Attorney at the ICTY at the Hague and lead counsel in the Kosovo portion of the Slobodan Milosovic trial\, will moderate a panel of the following three experts: \n\nCatherine Morris – Associate\, Centre for Asia-Pacific Initiatives\, University of Victoria\, Canada;\nWarren Fensom – UNODC Maritime Crime Prosecutions Mentor; and\nJonathan Ratel – EU Senior Advisor on Prosecutions\, Ukraine – 2019 – 2021.\n\nCatherine Morris will outline several mechanisms now being used or considered internationally to hold perpetrators accountable for atrocity crimes being committed into Ukraine and elsewhere. \nWarren Fensom will focus on three main legal questions: \n\nWhat is the law on targeting\, including the concepts of military objectives\, civilian objects and the concept of disproportionate damage to civil objectives;\nWhat is the law regarding attacking a nuclear power plant (and also applying question 1); and\nWhat are cluster munitions and thermobaric weapons? What is the specific law relating to them (and also applying question 1).\n\nJonathan Ratel will be speaking on recent events in Ukraine and the challenges of prosecuting war crimes in fragile States. Fox of Daune Morris LLP (an international law firm in the US). We are grateful for their presentations. \n  \nTopic: \n  \nBoth Kim Johnson and Michael Fox will be presenting on the following topics: \n  \n\nWhat are laws? A minimum code of conduct – generally for the common good – which can be understood and complied with by all.\n\n  \n\nWhat are ethics? From the Greek word “ethos” refer to established standards within a society of how humans ought to interact with each other – e.g. honesty\, fairness\, etc. – but a somewhat subjective test.   In North America the basis for ethics comes largely from the Constitutions – as over-arching statements of principles.\n\n  \n\nMethods of regulation in the legal industry\, accounting industry and medical industry – e.g. self-regulating\, co-regulating\, independent –  accountants with global  CFA organization with the goal of accurate disclosure in accounting statements\, etc. (cf. Enron)\n\n  \n\nTypes of legal organization – government – large firm – small firm – independent – does the organization/culture affect ethics?\n\n  \n\nLegal governance model in North America – Code of Conduct – State/Provincial Law Societies/Bar Associations\, etc. What do the various Codes say versus what is actually enforced?\n\n  \n\nGlobally – laws vary from locality to locality – e.g. state to state\, province to province. For instance\, in the US litigations (defendants) often want to avoid Texas and Alabama.  What the laws actually say and how the laws are enforced (“you aren’t from around here are you?).\n\n  \n\nDo ethics vary from locality to locality – or is there a common thread? Duty – trust – integrity.  Varying levels of trust – from trusting someone to take out your trash cans when you are on holiday versus trusting someone to look after your children\, etc.\n\n  \n\nEthics from a “micro” level to a “macro” level – e.g. the lawyer’s role in advocating a client’s interest versus the common good?  g. perspective on recent US election litigation.  When does that bright line get crossed and how it is enforced?   If the ends justify the means – when do the means become the ends?\n\n  \n\nClosing remarks – take away from this session?
