Topic:                 On May 15, 2026, the Supreme Court of Canada released Ahluwalia v. Ahluwalia, recognizing—for the first time in Canadian law—a distinct tort of intimate partner violence. This landmark 6-3 decision has significant implications for family law practitioners and civil litigators alike, reflecting the evolving legal understanding of family violence.

This two-hour seminar examines the decision through a family law lens, exploring how courts have historically approached allegations of family violence. It will also address the evidentiary challenges facing survivors and the practical realities of litigating these issues in proceedings where the court must consider the best interests of the child and the parties are often expected to maintain functional co-parenting relationships.

We will examine how the new tort interacts with established family law principles, unpack the majority’s three-part test, review the concerns raised in dissent, and consider the strategic, practical, and economic considerations involved in pursuing these claims. Attendees will leave with an understanding of how Ahluwalia may shape litigation at the intersection of family law and civil liability.
